Terms and conditions

These Terms and Conditions govern the use of wearworx.co.za and purchases from WearWorx (Pty) Ltd. They should be read together with our Delivery Policy, Returns and Refunds Policy and Privacy Policy.

1. Business information

The website and online store are operated by:

  • Full legal name: WearWorx (Pty) Ltd
  • Legal status: Private company registered in South Africa
  • Company registration number: 2023/863762/07
  • Registered address and address for legal service: 1 Epic Avenue, Terenure, Kempton Park, Gauteng, 1619, South Africa
  • Website: wearworx.co.za
  • Email: info@wearworx.co.za
  • Telephone: +27 68 642 9312
  • Office hours: Monday to Friday, 08:00–17:00, excluding public holidays

WearWorx operates exclusively as an online store. The registered address is not a retail shop, showroom, return counter or customer collection point.

2. Acceptance and consumer rights

By accessing the website, creating an account, requesting or accepting a quotation, approving artwork or placing an order, you agree to the version of these terms made available at that time.

If you place an order on behalf of a company or another person, you confirm that you have authority to bind that company or person.

Nothing in these terms excludes, limits or replaces any right or remedy that cannot lawfully be excluded under the Consumer Protection Act 68 of 2008 (“CPA”), the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”) or other applicable law.

If any provision conflicts with a mandatory legal right, the mandatory right will apply and the affected provision will be interpreted or limited only to the extent necessary.

3. Our business model and suppliers

WearWorx is an independent South African online retailer and reseller of corporate apparel, workwear, headwear, bags, promotional gifts and related products.

We source products and services from South African wholesale, manufacturing and branding partners, including Barron and Amrod. Product stock may be held and dispatched from a supplier or production partner’s warehouse.

Your purchase, payment and customer-service relationship remains with WearWorx. Customers must contact WearWorx—not a supplier—regarding orders, returns, refunds, defects or complaints.

References to Barron, Amrod or another supplier or brand identify the source or brand of a product. They do not mean that WearWorx is a branch, agent or official website of that supplier unless expressly stated and independently verifiable. All third-party trademarks and product names belong to their respective owners.

4. Customer accounts

You must provide accurate, complete and current information when creating an account, requesting a quotation or placing an order.

You are responsible for keeping your account credentials confidential. Tell us promptly if you suspect unauthorised use of your account or email address.

We may reasonably suspend or restrict an account to investigate suspected fraud, protect customers or the website, enforce these terms or comply with applicable law.

The store is intended for people with legal capacity to contract. A minor may order only with the assistance or consent required by law.

5. Products, descriptions and availability

We take reasonable care to provide accurate product names, descriptions, specifications, sizes, colours, images and availability information.

Product photographs and on-screen colours are guides. Screen settings, lighting, photography, fabric dye lots, manufacturing batches and reasonable production tolerances may cause differences in appearance.

Measurements and weights are approximate unless expressly guaranteed.

Stock information may be obtained from supplier systems and updated throughout the day. It represents the best availability information available to us but is not a reservation or guarantee. Adding a product to the basket does not reserve it.

Stock is only allocated once the order has been accepted, the required payment has cleared and, where applicable, the supplier has confirmed availability.

If an ordered product becomes unavailable, we will contact you and offer one or more of the following:

  • A reasonable substitute for your approval
  • A revised fulfilment date
  • Removal and refund of the unavailable item
  • Cancellation and refund of the affected order

We will not substitute a materially different product without your agreement.

6. Prices, taxes and quotations

All website prices are displayed in South African rand.

At the effective date of these terms, WearWorx is not registered as a VAT vendor. VAT is not added as a separate charge at checkout, and WearWorx does not issue VAT invoices.

The displayed product price is the customer price for the selected unbranded product or variant unless the page clearly states otherwise.

Optional branding, setup, digitising, artwork-redrawing, delivery or other additional charges are displayed separately before an online order is submitted or disclosed in a quotation.

Branding prices may depend on:

  • Branding method
  • Branding position and size
  • Number of colours
  • Quantity
  • Artwork quality
  • Product material
  • Setup or digitising requirements

Changing the quantity, branding method or product variant may change the applicable price.

A quotation remains valid for the period stated on it and is subject to stock availability and any assumptions or conditions recorded in the quotation.

If a product price or description contains an obvious error, we will notify you before fulfilment. You may accept the corrected information or cancel the affected order for a full refund.

We will not increase an accepted price unless you approve a change to the products, quantity, artwork, branding, delivery or other order requirements.

7. Placing and accepting orders

Products displayed on the website are invitations to place an order. They are not guarantees that stock has been reserved.

Submitting an online order or accepting a quotation constitutes an offer to purchase. An automated order acknowledgement confirms receipt of the order but does not necessarily constitute final acceptance.

A binding order is formed when WearWorx has:

  • Confirmed the products, quantity, price and available stock;
  • Accepted the required payment or approved credit arrangement; and
  • Where applicable, received approval of the final artwork proof.

If we cannot accept an order after receiving payment, we will refund the amount paid for products or services that will not be supplied.

Before submitting an order, check the product, colour, size, quantity, branding, delivery address and contact details carefully. Contact us promptly if anything is incorrect.

8. Branding, artwork and proofs

8.1 Artwork requirements

You must provide usable artwork and clear branding instructions.

We may recommend another file format, branding method, position or size where reasonably necessary for a satisfactory result.

Artwork redrawing, digitising, setup, colour matching or work outside the quoted scope may carry an additional charge. We will disclose the charge and obtain approval before proceeding.

8.2 Permission to use artwork

You retain ownership of artwork you supply.

You grant WearWorx and the production partners involved in your order a limited, non-exclusive licence to store, reproduce and adapt the artwork only as reasonably necessary to quote, prepare proofs, manufacture, brand, deliver, reorder and support the relevant products.

You confirm that you own the artwork or have permission to use and reproduce it.

To the extent permitted by law, you will be responsible for reasonable losses caused by a third-party claim arising from artwork or instructions you supplied without the required permission. This does not apply to the extent that the claim was caused by WearWorx’s own unlawful conduct or negligence.

8.3 Proof approval

WearWorx will provide an artwork proof before branded production begins.

You are responsible for checking:

  • Spelling and wording
  • Logos and artwork
  • Product and colour
  • Branding position
  • Branding size and orientation
  • Quantities
  • Contact and delivery information

Approval authorises production in accordance with the proof.

WearWorx remains responsible for a production error that materially differs from the approved proof, subject to reasonable production tolerances.

8.4 Production tolerances

Branding is a production process. Exact Pantone reproduction, stitch placement, print position or alignment may vary reasonably across materials, product sizes and manufacturing batches.

A minor variation within reasonable industry tolerance that does not materially affect the agreed appearance or use is not automatically a defect. This does not limit a statutory right to receive goods that reasonably match the approved proof and agreed specifications.

8.5 Prohibited artwork

We may decline artwork or instructions that are unlawful, infringing, hateful, threatening, deceptive or reasonably likely to harm another person.

If we decline an order before production, we will refund amounts paid for goods or services not supplied, less any lawful and previously disclosed charge for work already completed at your request.

9. Payment and fraud prevention

Available payment methods are displayed at checkout or recorded in the quotation.

Payment must clear before stock is reserved, dispatched or placed into production unless WearWorx has approved written credit terms.

You must be authorised to use the selected payment method. We may request reasonable verification to prevent fraud or unauthorised transactions.

Third-party payment processors apply their own terms and privacy notices.

We may pause or cancel an order if:

  • Payment is declined, reversed or not received;
  • The transaction is reasonably suspected to be fraudulent;
  • Required verification is not completed; or
  • Continuing the transaction would be unlawful.

If we cancel an order after receiving valid payment, we will refund the amount paid for goods or services that will not be supplied.

10. Delivery

Current charges and delivery estimates are published in our Delivery Policy and displayed or confirmed before an order is finalised.

At the effective date of these terms:

  • Delivery costs R150 per order;
  • Orders exceeding R1,500 qualify for free delivery;
  • Plain stock is ordinarily dispatched within 3–5 working days after payment;
  • Branded orders are ordinarily produced within 5–10 working days after artwork approval; and
  • Courier delivery ordinarily takes a further 1–3 working days after collection.

Delivery and production periods are estimates unless WearWorx expressly guarantees a date in writing.

We will take reasonable steps to inform you of a material delay.

The delivery address must be complete, accurate and accessible. Additional reasonable costs caused by an incorrect address, failed delivery or customer-requested rerouting may be charged after disclosure, unless the failure was caused by WearWorx or the courier.

Fulfilment may take place through a supplier or production partner’s warehouse and a third-party courier.

For a consumer transaction governed by the CPA, goods remain at WearWorx’s risk until you or your authorised recipient accepts delivery.

In other transactions, risk passes when the goods are delivered to the agreed address, to the extent permitted by law.

Ownership remains with WearWorx until full payment has been received, where permitted by law.

11. Inspection and delivery problems

Please inspect the parcel as soon as reasonably possible.

Contact WearWorx promptly if an item is:

  • Missing
  • Damaged during delivery
  • Incorrectly supplied
  • Incomplete
  • Defective
  • Materially different from the approved artwork proof or order

Provide the order number and photographs where reasonably useful.

Prompt notice helps us investigate with the courier, supplier or production partner. It does not remove a statutory right that applies for a longer period.

12. Cancellations, returns and refunds

12.1 Return authorisation

Contact WearWorx before returning anything.

We will provide a return reference and the correct return address. Goods must not be sent to our registered address or directly to Barron, Amrod or another supplier unless WearWorx provides those instructions.

12.2 Unbranded goods and change-of-mind returns

Where the ECTA cooling-off right applies, an eligible customer may notify WearWorx of a change-of-mind return within seven calendar days after receiving the goods.

The goods must be:

  • Unused and unworn
  • Undamaged
  • In their original packaging
  • Accompanied by all labels, accessories and components

The customer is responsible for the direct cost of returning change-of-mind goods.

The cooling-off right may not apply to goods made to the customer’s specifications, clearly personalised goods or other goods excluded by applicable law.

12.3 Branded and personalised products

Branded, embroidered, printed, engraved, altered, personalised or specially sourced goods cannot be returned merely because the customer changed their mind.

This restriction does not apply where the goods are defective, damaged, incorrectly supplied or materially different from the approved artwork proof or order.

12.4 Faulty, damaged or incorrectly supplied products

Contact WearWorx as soon as reasonably possible with:

  • The order number
  • Details of the problem
  • The product and quantity concerned
  • Supporting photographs where appropriate

Where applicable law requires it, WearWorx will arrange and cover the reasonable return cost.

Depending on the circumstances and the customer’s applicable rights, the goods may be repaired, replaced or refunded.

WearWorx may coordinate inspections, collections, replacements or credits with Barron, Amrod or another product or branding supplier. Supplier procedures do not reduce any applicable statutory consumer rights.

12.5 Cancellation before delivery

Contact us as soon as possible if you wish to cancel or change an order.

An unbranded order may be cancelled before dispatch unless a lawful exception applies.

For a branded, personalised or special order, WearWorx may deduct a reasonable and disclosed amount for:

  • Work already completed at your request;
  • Non-returnable stock specifically ordered;
  • Approved branding setup or preparation; and
  • Other actual loss caused by the cancellation, where permitted by law.

Once custom production has begun, a change-of-mind cancellation may not be available.

12.6 Refunds

Approved refunds are made to the original payment method unless another lawful arrangement is agreed.

We aim to process an approved refund within 10 working days after the returned goods have been received and assessed.

Any shorter or otherwise different mandatory legal refund period will take priority.

Further information is available in our Returns and Refunds Policy.

13. Defective goods and warranties

Where the CPA applies, goods carry the statutory warranty of quality.

If goods fail to meet the applicable statutory standards within six months after delivery, the consumer may be entitled to return them without penalty and at the supplier’s risk and expense and choose a repair, replacement or refund, subject to the CPA.

These rights do not cover a problem caused by:

  • Misuse or negligence
  • Failure to follow care or usage instructions
  • Ordinary wear and tear
  • Unauthorised alteration or repair
  • Damage occurring after delivery and outside WearWorx’s control

Personalisation does not remove applicable statutory rights relating to defective, unsafe or incorrectly supplied goods.

Any applicable manufacturer warranty is additional to rights that cannot lawfully be excluded.

14. Promotions and discounts

Promotions and discount codes are subject to their published dates, eligible products, quantities and other stated conditions.

Unless expressly stated otherwise, promotions cannot be combined, exchanged for cash or applied retrospectively.

We may refuse or reverse a discount obtained through an obvious error, manipulation, fraud or breach of the promotion rules, while treating affected customers fairly and complying with applicable law.

15. Website availability and acceptable use

You may not:

  • Use the website unlawfully or fraudulently;
  • Interfere with its operation, security or another person’s access;
  • Introduce malicious software or attempt unauthorised access;
  • Submit false, unlawful, harmful or infringing content;
  • Use automated systems to place fraudulent or abusive orders; or
  • Copy or scrape website content at scale for a competing catalogue or service without written permission.

We may restrict access where reasonably necessary to protect the website, WearWorx or other users.

We do not guarantee that the website will always be uninterrupted or error-free. This does not affect an accepted order or any applicable statutory right.

16. Intellectual property

WearWorx or its licensors own the website design, text, graphics, software, catalogue arrangement and WearWorx branding, excluding customer-supplied artwork and third-party product or brand material.

You may browse the website, purchase products and retain electronic copies of these terms and your transaction records.

No other licence is granted unless WearWorx agrees in writing or applicable law permits the use.

Third-party trademarks, supplier names and product names remain the property of their respective owners.

17. Limitation of liability

This section applies only to the extent permitted by law.

Nothing in these terms excludes or limits liability for:

  • Fraud or fraudulent misrepresentation;
  • Gross negligence or wilful misconduct;
  • Death or personal injury caused by negligence;
  • Defective or unsafe goods where liability cannot lawfully be excluded; or
  • Any mandatory consumer right.

To the extent permitted by law, WearWorx is not responsible for indirect or consequential loss that was not reasonably foreseeable when the agreement was formed, including loss of profit, opportunity or goodwill.

This exclusion does not apply to direct loss caused by WearWorx’s breach or negligence where applicable law makes WearWorx responsible.

For a business transaction to which mandatory consumer protections do not apply, WearWorx’s aggregate liability arising from an order is limited to the amount paid for the affected goods or services, except where such a limitation is prohibited by law or the loss resulted from fraud, gross negligence or wilful misconduct.

18. Events beyond reasonable control

Neither party is responsible for a delay caused by an event beyond its reasonable control, including:

  • Natural disasters or extreme weather
  • Widespread power, communications or technology failures
  • Civil disturbance
  • Strikes or industrial action
  • Border, transport or courier disruption
  • Government action
  • Supplier or production failure that could not reasonably have been prevented

The affected party must take reasonable steps to minimise the impact and resume performance.

This section does not excuse payment already due or remove a customer’s statutory right to cancel because of a material delay.

19. Privacy and customer information

WearWorx processes personal information as described in our Privacy Policy.

If you provide another person’s delivery or contact information, you confirm that you are authorised to do so and will make the Privacy Policy available to that person where appropriate.

Uploaded artwork may be shared with the product, branding, technology and delivery partners reasonably required to fulfil the order.

20. Electronic communications

You agree that orders, quotations, proofs, approvals, invoices, notices and other communications may be sent electronically to the email address or account you provide.

You should retain copies of these terms, approved proofs, invoices and order records.

An electronic communication is treated as received when it becomes capable of being retrieved at the recipient’s designated electronic address, subject to ECTA and proof to the contrary.

Legal notices to WearWorx may be delivered to the registered address in Section 1 and copied to info@wearworx.co.za.

21. Complaints and dispute resolution

Send complaints, the relevant order number and supporting information to info@wearworx.co.za.

We will attempt to investigate and resolve complaints reasonably and promptly.

These terms and all orders are governed by South African law.

A consumer may approach any court, tribunal, consumer commission, ombud or other dispute-resolution forum available under applicable law.

Nothing in these terms prevents either party from seeking urgent legal relief or using a statutory complaint process.

For any other dispute, the parties consent to the jurisdiction of a competent South African court, including a Magistrates’ Court with jurisdiction, without preventing a party from approaching another court with wider jurisdiction where lawful.

22. General provisions

22.1 Entire agreement

The accepted order, quotation, approved artwork proof, these terms and the policies linked above form the agreement relating to the order.

An expressly agreed order-specific term will take priority over these general terms for that order.

22.2 Updates

WearWorx may update these terms for future website use and future orders by publishing a revised version and effective date.

A change will not alter an already accepted order unless both parties agree or applicable law requires it.

22.3 Severability

If any provision is invalid or unenforceable, it will be interpreted, limited or severed only to the necessary extent. The remainder of the terms will continue to apply.

22.4 No waiver

A failure or delay in enforcing a right does not constitute a waiver of that right.

22.5 Transfer

You may not transfer an order without WearWorx’s consent.

WearWorx may transfer its rights and obligations as part of a genuine sale, restructuring or reorganisation of the business, provided that doing so does not reduce a consumer’s applicable rights.

22.6 Headings

Headings are included for convenience and do not affect the interpretation of these terms.
