4. How we collect information
We collect information:
- directly from you when you use the website, order, upload artwork or contact us;
- from a person ordering for you or arranging delivery to you;
- from our payment, courier, production, technology and customer-service providers;
- automatically through cookies, server logs and similar website technologies; and
- from public business sources where reasonably necessary to verify a business customer or protect against fraud.
If you give us another person’s information, you must be authorised to do so and must make this policy available to that person where appropriate.
5. How and why we use information
We process personal information only where POPIA and other applicable law allow it. We use it to:
- create and manage customer accounts;
- answer enquiries and prepare quotations;
- confirm stock, process payments, fulfil orders, arrange branding and deliver goods;
- prepare and obtain approval for artwork proofs;
- provide invoices, order updates and customer support;
- handle cancellations, returns, refunds, complaints and warranty claims;
- keep tax, accounting and other legally required records;
- secure the website, prevent fraud and enforce our agreements;
- operate, test, troubleshoot and improve our website and services;
- measure how customers find and use our store; and
- send permitted marketing and manage your communication preferences.
Depending on the circumstances, our justification may be your consent, taking steps at your request before entering into a contract, performing a contract, complying with a legal obligation, or pursuing our or a third party’s legitimate interests in operating and protecting the business. Where we rely on consent, you may withdraw it at any time, although this will not affect processing already done lawfully.
You may choose not to provide optional information. If information is necessary to quote, process payment, produce branding or deliver an order, we may be unable to provide that part of the service without it.
6. Who we share information with
We may share only the information reasonably necessary with:
- suppliers, decorators and production partners that source or brand your goods;
- couriers, freight providers and delivery recipients;
- payment processors, banks and fraud-prevention providers;
- website hosting, ecommerce, email, backup, security, analytics and IT service providers;
- accountants, auditors, insurers, lawyers and other professional advisers;
- regulators, law-enforcement bodies, courts or other authorities where disclosure is required or permitted by law; and
- a buyer, investor or adviser involved in a genuine sale, merger or reorganisation of all or part of our business, subject to appropriate confidentiality measures.
Service providers may use the information only for the agreed service or another lawful purpose. We do not sell personal information.
7. Payments
The payment methods available to you are shown at checkout or on your quotation. Where a third-party payment provider processes a payment, that provider receives payment details directly and applies its own privacy and security terms. WearWorx ordinarily receives the transaction reference, amount, payment status and limited payer information needed to match the payment to the order. Please review the payment provider’s privacy notice before completing payment.
8. Cookies and similar technologies
Cookies are small files stored on your browser or device. Our website and its service providers may use:
- Essential cookies to keep the store secure, remember your cart, support checkout, authenticate accounts and maintain a session.
- Preference cookies to remember choices and improve convenience.
- Measurement and attribution technologies to understand visits, referrals and whether the website is working as intended.
- Marketing technologies only where enabled and lawfully used, to measure or personalise marketing.
You can block or delete cookies in your browser. Blocking essential cookies may prevent the cart, account or checkout from working. Where the website presents a cookie preference tool, you can also change non-essential cookie choices there.
9. Direct marketing
We will send electronic direct marketing only where permitted by law. You may opt out at any time by using the unsubscribe option in a message or emailing info@wearworx.co.za. We may still send non-marketing communications needed for an enquiry, quote, order, account, recall or legal notice.
10. Cross-border processing
Some service providers or their systems may be located outside South Africa. If we transfer personal information to another country, we will use a method permitted by POPIA, such as transferring it to a recipient subject to an adequate law, binding agreement or corporate rules that provide an appropriate level of protection, or relying on another lawful basis for the transfer.
11. How long we keep information
We keep personal information only for as long as reasonably necessary for the purpose for which it was collected, to maintain required business and tax records, to resolve disputes and to meet legal, accounting or reporting obligations. Transaction and tax records may need to be kept for at least five years, or longer where applicable law or a dispute requires it. Artwork and approved proofs may be kept to support repeat orders, production records and claims. When information is no longer required, we delete, destroy or de-identify it in a reasonably secure manner, subject to backup cycles and legal holds.
12. How we protect information
We use reasonable technical and organisational safeguards designed to protect personal information against loss, unauthorised access, interference, misuse, alteration or disclosure. These measures may include access controls, protected accounts, encryption in transit, system updates, backups, provider controls and staff confidentiality requirements. No internet or storage system can be guaranteed to be completely secure.
If a security compromise affects your personal information, we will investigate and notify the Information Regulator and affected people where POPIA requires it.
13. Your rights
Subject to POPIA and other applicable law, you may ask us to:
- confirm whether we hold personal information about you;
- give you access to that information or a description of it;
- correct or update inaccurate or incomplete information;
- delete or destroy information that we are no longer authorised to retain;
- restrict certain processing while an issue is considered;
- record an objection to processing on reasonable grounds;
- withdraw consent where processing is based on consent; or
- stop direct marketing.
Email your request to info@wearworx.co.za. We may ask for enough information to verify your identity and locate the relevant records. Some requests may be limited where the law requires or permits us to retain information, protect another person’s rights, preserve confidential information or charge a prescribed access fee. Formal access-to-record requests may be dealt with under the Promotion of Access to Information Act 2 of 2000 (“PAIA”).
We do not ordinarily make decisions that have legal or similarly significant effects on you solely through automated processing.
14. Children
Our store is intended for customers who can lawfully enter into a contract. We do not knowingly ask children to create accounts or place orders without a competent person’s authorisation. If you believe a child has provided personal information without appropriate authorisation, please contact us so that we can investigate.
15. Third-party sites
Our website may link to third-party websites or social-media services. Their privacy practices are governed by their own notices. We encourage you to read those notices before providing information to them.
16. Changes to this policy
We may update this policy when our services, providers or legal obligations change. We will post the updated version on this page and change the effective date. Where a change materially affects how we use information already collected, we will take additional steps where required by law.
